Anderson, Indiana Aug 17, 2026 (Issuewire.com) Discovery remains active in the federal administrative proceeding Peters v. Checkout.com, Case No. 2026-CFP-00004, while Checkout.com prepares a forthcoming challenge under the Consumer Financial Protection Act.

An August 10 order issued by Administrative Law Judge Heather C. Leslie granted Checkout.com additional time to submit its Complaint Response but made clear that the extension does not pause the discovery process. The order states: Discovery will continue and is ongoing.

The proceeding stems from a complaint filed by James Peters with the U.S. Department of Labors Occupational Safety and Health Administration in January 2026 alleging violations of the employee-protection provisions of the Consumer Financial Protection Act, 12 U.S.C. § 5567. OSHA dismissed the complaint on February 25, 2026, and Peters appealed. The Office of Administrative Law Judges docketed the case on March 24, 2026.

Judge Leslie was assigned the case on July 7 and issued a preliminary order on July 16 establishing procedural deadlines. Peters filed his Pleading Complaint on July 30.

Checkout.com subsequently requested a fourteen-day extension to prepare its response. According to the order, the company indicated that its filing will include a challenge to Peterss standing under § 5567.

Judge Leslie characterized that issue as a threshold issue and concluded that permitting Checkout.com additional time to fully brief the challenge constituted good cause. The order also provides that Peters will be given time to respond to the anticipated challenge.

The judge found that the extension would not unduly delay the proceeding or prejudice Peters.

Checkout.coms Complaint Response is now due on or before August 27, 2026.

The August 10 order does not determine the anticipated standing challenge and does not resolve the merits of Peterss underlying CFPA allegations. Instead, it establishes the next procedural stage while expressly allowing discovery to continue.
