NEW YORK, NY – Drivers facing aggravated DWI charges in New York confront some of the harshest penalties in the state’s alcohol-related offense structure, including elevated fines, extended license revocations, and the possibility of jail or state prison. According to Manhattan DWI defense attorney Rachel Kugel, aggravated DWI under New York Vehicle and Traffic Law Section 1192(2-a) applies in two distinct situations: when a driver’s blood alcohol concentration is 0.18% or higher, or when a person drives while intoxicated with a child age 15 or younger in the vehicle. “The aggravated label signals a meaningfully more serious charge, because the conduct is viewed as creating a greater risk to public safety,” Kugel explains. The high-BAC prong is treated as an enhanced misdemeanor for a first offense, while the child passenger prong is a Class E felony from the outset.

 

Manhattan DWI defense attorney Rachel Kugel notes that the BAC prong is a “per se” offense, meaning the chemical test result alone can establish the charge. Prosecutors do not need additional evidence of impairment, such as poor driving or failed field sobriety tests, when a test of breath, blood, saliva, or urine shows a reading of 0.18% or higher. Because 0.18% is more than double the 0.08% standard DWI threshold, the certification, calibration, and maintenance records for the testing device often become central to a defense.

 

The child passenger prong, known as Leandra’s Law, applies when a driver violates New York’s DWI or DWAI provisions while a child age 15 or younger is a passenger. Kugel points out that this prong makes the charge a Class E felony even on a first offense, regardless of the driver’s exact BAC. “The presence of a minor in the car can transform an otherwise misdemeanor-level situation into a felony case, with exposure to state prison and an extended license revocation,” she observes.

 

The penalties escalate sharply with repeat offenses. A first aggravated DWI is a misdemeanor carrying a fine of $1,000 to $2,500, up to one year in jail, and a mandatory license revocation of at least one year. A second aggravated DWI within ten years is a Class E felony, punishable by a fine of $1,000 to $5,000, up to four years in prison, and a revocation of at least 18 months. A third within ten years is a Class D felony, carrying a fine of $2,000 to $10,000, up to seven years in prison, and a revocation of at least 18 months.

 

Kugel emphasizes that a conviction triggers consequences well beyond fines and jail. A mandatory surcharge of $395 applies to a misdemeanor conviction and $520 to a felony conviction, with a $5 add-on in town or village courts. An ignition interlock device is required as a condition of sentencing, and courts may impose up to three years of probation. The New York State Department of Motor Vehicles may also require completion of the Impaired Driver Program as part of relicensing.

 

Attorney Kugel highlights a significant administrative change that took effect February 16, 2026. Under the updated DMV point system, an aggravated DWI conviction now adds 11 points to a driver’s license, and because 10 or more points within a 24-month window triggers an automatic suspension review, a single conviction can immediately jeopardize driving privileges. The conviction also carries a Driver Responsibility Assessment fee of $250 per year for three consecutive years, totaling $750. “These administrative penalties operate entirely separately from the criminal court case,” Kugel adds. “A person can face them even when a defense attorney helps avoid jail time in court.”

 

Kugel also notes that plea bargaining an aggravated DWI is more restricted than reducing a standard DWI. For Leandra’s Law cases, state law generally prevents a reduction to a non-criminal DWAI unless the district attorney determines the charge is unwarranted. For high-BAC charges, local county policies, including those in Manhattan, typically limit reductions below a standard misdemeanor DWI. Kugel advises that license consequences begin at arraignment through New York’s prompt suspension procedure, separate from the longer revocation that follows a conviction, which is why acting quickly can help preserve limited driving privileges.
